Terms of Service Agreement

By accessing or using Conjures Up services, content, downloads, accounts, community features, or digital products, you agree to these Terms.

Important: If you do not agree to these Terms, please do not use the Services. Children may not access or use the Services unless their use is directly authorized by a parent, guardian, or another authorized adult who agrees to be bound by these Terms.

1. Acceptance of Terms

By accessing, downloading, using Content from the Services, or contributing Content to the Services, you agree that you are entering into these Terms with Conjures Up, which become a legally binding agreement between you and us.

We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time. The most current version will be posted on this page. Continued use of the Services after changes become effective constitutes acceptance of the changed or modified Terms.

2. Content

In these Terms, “Content” means content available on the Services, including but not limited to:

✦ Images: photographs, vector graphics, drawings, and illustrations.

✦ Videos: moving images, animations, film footage, and other audio-visual content.

✦ Audio: music, sounds, sound effects, and other audio content.

✦ Other Media: any other visual, audio, or combined media content.

3. CC0 License

Some Content made available for download may be subject to the Creative Commons Zero license. CC0 Content may be used for personal and commercial purposes without attribution, subject to the applicable CC0 license terms and any third-party rights that may apply.

4. Content License

Subject to the Prohibited Uses below, when you download Content that is not CC0 Content, Conjures Up grants you an irrevocable, worldwide, non-exclusive, royalty-free right to download, use, copy, modify, or adapt the Content for commercial or non-commercial purposes.

Prohibited Uses include:

✦ Selling or distributing Content on a standalone basis in digital or physical form.

✦ Using Content containing trademarks, logos, or brands for commercial goods or services without permission.

✦ Using Content in pornographic, obscene, offensive, illegal, immoral, infringing, defamatory, hateful, threatening, or libellous contexts.

✦ Using Content in a misleading or deceptive way, including implying endorsement, affiliation, ownership, or exclusive rights where none exist.

Before using any Content, including CC0 Content, you are responsible for determining whether third-party consent or additional licensing is required.

5. Attribution

You do not need to credit Conjures Up or the contributor of Content when you use it, but attribution is appreciated, especially for editorial use. Suggested format: “by [Contributor] via Conjures Up.”

6. Uploading Content

When you upload Content to the Services, you grant Conjures Up an irrevocable, perpetual, worldwide, non-exclusive, royalty-free license, with the right to sublicense, to use, market, reproduce, display, exhibit, broadcast, publicly perform, enhance, alter, adapt, modify, or download the Content for commercial and non-commercial purposes.

You represent and warrant that you own or control all rights required for the Content you upload and that use of the Content under these Terms will not infringe the rights of any person or entity.

You agree not to upload Content that is sexually explicit or pornographic, offensive, defamatory, discriminatory, or that promotes or creates a risk of physical or mental harm. Conjures Up may remove Content at any time and for any reason.

6B. Generative AI Content

You may upload Content created with generative AI technology only if the following conditions are met:

✦ You are responsible for ensuring the AI tool terms permit you to grant the licenses and warranties required by these Terms.

✦ AI-generated Content must be clearly labelled as AI-generated where applicable.

✦ AI-generated Content must not be tagged with names of real people, artists, trademarks, or brands.

✦ You must not upload AI-generated Content that mimics another artist’s style or attempts to reproduce protected copyright, trademark material, or the image of a real person.

7. Use of the Service

You may be required to register to access certain features. If you register, you agree to provide and maintain true, accurate, and current information. Registration data is subject to the Privacy Policy.

✦ Data mining, extraction, scraping, and automated data collection are prohibited.

✦ You may not copy, modify, reverse engineer, assign, sublicense, or transfer rights in the technology or software underlying the Services unless expressly permitted.

✦ Bulk, large-scale, or systematic copying of Content is prohibited without explicit permission.

8. Termination

Conjures Up may terminate your access to the Services at any time, for any reason, without giving reasons, and may prohibit further use of the Services. Upon termination, your right to use the Services immediately ceases.

9. Reporting & Takedown

Conjures Up respects the rights of creatives. If you believe your intellectual property rights have been infringed by Content accessible through the Services, contact us with the relevant details.

Your notice should identify the right allegedly infringed, the Content at issue, its URL, your contact information, a good-faith statement, and a declaration that the information is accurate and that you are authorized to act.

10. Infringement Claims

If you become aware of a claim relating to Content and Conjures Up may be liable, you must stop using the Content immediately, delete or remove the Content from your systems and storage, ensure your clients, printers, or service providers do the same, and notify Conjures Up as soon as possible.

11. Indemnification

You agree to indemnify, release, and hold harmless Conjures Up and its affiliates from losses, expenses, damages, and costs, including reasonable attorney fees, resulting from your violation of these Terms or third-party claims arising from your use of the Services.

12. Dispute Resolution & Applicable Law

Conjures Up will endeavour to resolve disagreements amicably. Where applicable, online dispute resolution information may be available through the European Commission. The uploaded Terms reference German law and Berlin jurisdiction language; confirm this section with legal counsel before publishing if Conjures Up operates from another jurisdiction.

13. Warranty & Liability

THE SERVICES AND CONTENT ARE PROVIDED “AS IS.” CONJURES UP OFFERS NO WARRANTY, EXPRESS OR IMPLIED, REGARDING CONTENT, SERVICES, ACCURACY OF INFORMATION, OR RIGHTS OR LICENSES UNDER THIS AGREEMENT.

CONJURES UP SHALL NOT BE LIABLE FOR GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, LOST PROFITS, OR OTHER DAMAGES, COSTS, OR LOSSES ARISING OUT OF USE OF THE SERVICES OR CONTENT.

14. Severability

If one or more provisions of this agreement is found invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected. Such provisions should be revised only to the extent necessary to make them enforceable.

15. EU Monthly Active Users

The uploaded Terms reference EU Digital Services Act monthly active user language. Confirm whether this section applies to Conjures Up before publishing.
